Breathalyzer/BAC Test Attorney Serving the Bay Area and Oakland
- Were you pulled over on suspicion of drunk driving?
- Were you administered a Breathalyzer, Intoxilyzer, or blood-alcohol test?
If you have been pulled over for drunk driving in California, chances are the police officer administered a Breathalyzer test, blood-alcohol content (BAC) test, or another test to check your sobriety. However, these tests do not always accurately check an individual's level of intoxication — but they are still used as evidence in many cases.
At the Law Office of Thomas F. McKenna, I defend people who have been charged with drunk driving. I am experienced in challenging the evidence supplied in Breathalyzer, Intoxilyzer and BAC tests. To find out more, contact my Walnut Creek law office at 925.933.7500 during business hours.
Refusing Sobriety Tests — A Good Idea?
In California, an individual pulled over for suspicion of drunk driving is required to submit to one of two chemical tests: a breath or blood test It is never wise to refuse one of these tests: your driver's license can be suspended for one or two years, depending on your prior record.
Reliability of Breath and BAC Tests
Although the blood-alcohol test is quite reliable, the breath test is not. If you have been charged with drunk driving based on the results of a Breathalyzer test, it may be possible to challenge its accuracy.
Attorney Tom McKenna has defended thousands of individuals charged with DUI/DWI, and knows how inaccurate breath tests often are - even though these tests are often used as evidence in cases.
Tom McKenna is a founding member of the California Deuce Defenders, a bar association for DUI lawyers throughout the state, which today is known as the California DUI Attorneys Association. Mr. McKenna is one of around 30 specialist members.
