DUI Defense in the Bay Area and Oakland
Have you been arrested for DUI/drunk driving? If so, you must request a DMV hearing within 10 days of your arrest or you will lose your driver's license. Additionally, you may be required to appear in court.
At the Law Office of Thomas F. McKenna, we defend people charged with drunk driving, representing them both in DMV hearings and in criminal court. If you have been arrested, contact our law firm as soon as possible. Call 925.933.7500 during business hours or 925.407.5359 after hours.
DMV Hearings
Within 10 days of your drunk-driving arrest, you must schedule a DMV administrative hearing - or you risk losing your license. When you call the DMV, they will issue a stay of the suspension of your license so you can drive - pending the outcome of the hearing. In regards to DUI defense, the stay allows us time to properly prepare your case.
The DMV will try to rush you through your case and suspend your license. You have virtually no chance of winning if you represent yourself. If your goal is to save your license and maintain your driving privileges, choosing an extremely experienced lawyer to represent you is critical.
Criminal Cases
A DUI case is a criminal case and is often very complicated. Thomas McKenna has decades of experience aggressively defending clients charged with drunk driving. His proactive approach can be very beneficial to his clients.
In many cases, attorney Tom McKenna appears in court on behalf his clients. It is not always necessary or helpful for the defendant to appear before a judge. However, in more serious cases, the judge may request that the defendant come back for the second court date.
An Honest Approach to DUI Defense
For a second or third DUI offense, having legal representation can greatly affect the outcome of a case. But for first-time offenses, if we believe we cannot do anything for a client, we will tell them. Further, we will tell them what to expect in their court appearance, and what steps we would recommend taking.
If we believe having a lawyer will not help your case, attorney Tom McKenna will talk with you at no cost and discuss your options with you.
In addition to representation in DMV hearings and in court, we offer the following services to clients:
- DUI defense
- Felony DUI
- Multiple DUI
- DUI with injury
- License suspension and DMV hearings
- Breath/blood-alcohol content tests
- Underage drinking
